Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using https://www.hoophouseusa.com (“the Site”) operated by Hoop House USA (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https:/ www.hoophouseusa.com.
By accessing or using the Site in any manner, including but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound to these Terms and Conditions. Capitalized terms are defined in this Agreement.
Intellectual Property
The Site and it’s original content, features and functionality are owned by Hoop House USA and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws
Pricing and Availability
Any pricing information listed on this website is subject to change without notice. Hoop House USA typically does not match competitors’ pricing but may consider it before the sale. Hoop House USA will not adjust pricing after the sale is complete.
Certain items listed as part of our inventory may be discontinued or may be unavailable from time to time; contact us for current availability. While it is a rarity that an item ordered through our site is no longer be available due to manufacture obsolescence. Should an item ordered no longer be available due to its obsolescence we will contact you if no other comparable, equal, or better alternative is available. Should a comparable, equal or better alternative item be available we reserve the right to ship that product. Hoop House USA may make improvements and/or changes in products, programs, and pricing at any time.
In an effort to bring you the most competitive price, not all products we offer are stocked and warehoused at our warehouse. Therefore we ship these non-stock products directly from the manufacturer. Orders shipped from a manufacturer are not subject to our control and shipping times vary. Not all items listed are kept in stock for immediate delivery. Purchasers will be notified if an item ordered is out of stock, backordered or special order.
Shipping
We make every effort to fabricate and ship orders from our California warehouse within 3 – 5 business days of receipt. This is however, not always possible due to various reasons.
Hoop House USA has free shipping on all kits on the website. Free shipping applies to the continental United States ONLY. Other areas outside the U.S. states such as Hawaii or Alaska will require additional shipping fees. Taxes and Duties for shipments outside the U.S. are the responsibility of the customer.
“Free shipping” does not imply that we are not charged for shipping your product. The shipping rates we are charged by the carrier is factored into the sale price of the product. Occasionally there may be errors in these calculations for various reasons. In these cases you may be contacted with the additional shipping costs.
Most of our items ship freight. All residential freight shipments are schedule for curbside delivery and someone must be there to inspect and receive the delivery. Because our pallets are large to accommodate the large metal pieces making up the hoop house, lift gates are not available during delivery. This means that you will need equipment like a forklift to remove the pallet from the delivery truck.

The Site may contain links to third-part sites that are not owned or controlled by Hoop House USA. We have no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We highly recommend that you read the terms and conditions and privacy policy of any third party site that you visit.
Limited License
Hoop House USA grants you a non-exclusive, non-transferable, limited license to use in the Site in accordance with this Agreement.
Warranty Disclaimer
Hoop House USA does not warrant the accuracy, completeness or usefulness of the information, text, links, or other items contained on the Site. We disclaim all warranties, representations and endorsements, expressed or implied, with regard to the information access via the Site including but not limited to all express and implied warranties of merchantability, fitness for a particular purpose. Hoop House USA does not warrant that the Site will function uninterrupted, secure or available at any particular time or location, any errors or defects will be corrected, the Site is free of viruses or other harmful components or the results of using the Site will meet your requirements.
Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Changes to the Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
